Business Torts And Intellectual Property

Scenario: Sam is an employee of ABC Paper Corp. He signed a non-disclosure agreement as a condition of his employment with ABC. Sam is approached by XYZ Paper Co. with an offer of employment, but only if he brings his client list with him. Sam was fully responsible for creating his client list, so he agrees to provide it to XYZ. When Sam downloads his client list onto an external flash drive, he is caught in the act by his boss Natalie. Sam grabs the flash drive and runs out of his office, shoving Natalie aside when she attempts to stop him. Natalie falls and hits her head against the doorknob, suffering a concussion.

Format your paper consistent with APA guidelines.

discrimination

Not all discrimination is prohibited by law. For example, employers routinely discriminate between potential employees based upon education or experience. Other types of discrimination are more subtle, but still legal. For example, some employers discriminate between potential employees based upon personal characteristics such as weight or attractiveness. Should employers be permitted to discriminate based upon attractiveness? Take a side and argue that an employer should or should not be permitted by law to discriminate against persons who are not attractive.

leagal case

In each case, answer the questions at the end of the case and give researched references to support your assertions; also, explain what would be the ethical course of action and the legal requirements for action in the case.
Case One
Mrs. Lewis was head nurse on a medical surgical floor in a community hospital with 250 beds. Over the course of 6 months, she noticed that all patients admitted from the Shady Rest Nursing Home had signs of severe injuries other than those connected with the admitting diagnosis. There appeared to be patient abuse in the nursing home. Mrs. Lewis investigated discreetly and found no explanation possible except abuse. In accord with the obligations of the law in her state, she reported the matter to the Department of Welfare Bureau of Inspection.
The Welfare Department investigated immediately, found proof of abuse, and threatened to close down Shady Rest if there were any more recurrences. Mrs. Lewis was overjoyed until her hospital administrator, bypassing the director of nursing, called her in and warned her that she would be fired if she reported any other instances of abuse. Shady Rest sent the hospital a lot of business, and good relations had to be maintained.
Mrs. Lewis was even more shocked when she discovered that the administrator was a golf partner of the owner of Shady Rest and was doing an old buddy a favor. Despite fears of retaliation, Mrs. Lewis consulted a lawyer, who threatened the hospital with exposure and with penalties that would follow if one of its employees failed to follow the reporting provisions of the law on abuse in nursing homes.
Did Mrs. Lewis act correctly? What should she have done if she could not have afforded to consult with a lawyer? In what ways can whistle-blowers protect themselves? Must the art of intimidation be part of the toolbox of healthcare professionals in order to protect their patients? Is power an appropriate consideration in healthcare ethics?
Case Two
On a July weekend, Mrs. Allesfertig, nursing supervisor of the whole hospital, discovered that the intensive care unit was seriously understaffed. She pulled two nurses with previous ICU experience off other floors to bring the unit up to strength in view of the extreme level of acute care needed. On the following Monday, Dr. Bestknabe, who has overall responsibility for the ICU unit, closed the unit for further admissions until the staffing had been worked out on a permanent basis.
Should the new staffing policy give the nurses authority to refuse to admit patients when the staff is not sufficient to handle them? (In some hospitals, nurses have this authority.) Can any policy take precedence over the professional judgment of trained ICU nurses?

Cultural Considerations Presentation

Your Learning Team has been chosen to develop a training model for a local company that provides mental health services. Consider the topics and models covered on sensation, and perception. I want to see how these concepts help these mental health employees do their jobs. Create a 2-4 slide Microsoft® PowerPoint® presentation: 1-2 slides for sensation and 1-2 slides for perception that provides this organization with scenarios that would help them to identify when cultural aspects should be considered. Each slide should list the model or theory addressed and a scenario to help the organization grasp the key concepts. One of the key elements in this assignment is to highlight cultural distinctions that help in the training model. As this is a PPT – your notes on each slide will be evaluated as to how they support the slide and the points noted in them. Please include speakers notes and in-text citations on the slides for all references. Please use the attached rubric to clarify this assignment.

career paths

shown that certain combinations of personality traits fit well with different career paths. Thus, personality trait tests for specific jobs can be predictive of both success and satisfaction. Understanding your own personality-trait combinations can give you great insight into your own strengths and weaknesses. With this understanding, you can work to grow your strengths and minimize your weaknesses.
In this assignment, you will explore your personality using a personality test and then analyze the results.
Part 1
First, explore your personality preferences by completing Myers-Briggs Type Indicator (MTBI). The full version of the test can only be administered by a trained professional; however, there are many online informal versions of the test which you can find on the Internet. You can search for the test using any one of the following keywords:
Personality test + Myers-Briggs typology Myers-Briggs test Record your four-lettered personality type after completion of the test and use the Internet to interpret your personality type.
Part 2
In this part of the assignment, you will write a research paper that analyses your results. Do the following:
Mention your four-letter type and the URL of the Web site where you took the test. Discuss whether this type accurately represents what you know about yourself. Examine the four spectrums and explain your answer thoroughly. Substantiate your agreement or disagreement with real-life behavioral examples. Analyze what you consider the strengths and the weaknesses or challenges of this type. List three strengths and three weaknesses and provide a rationale for each. Evaluate why this test could be a valuable tool for an employer. Analyze how a clinician may use this test as a tool for promoting meaningful interventions in treatment. Summarize what you have learned about yourself through this exercise.
Write a 3–4-page paper in Word format. Apply APA standards to citation of sources. Use the following file naming convention: LastnameFirstInitial_M4_A2.doc.

Résumé and an Application Letter

you are tasked to write your Résumé and an Application Letter targeted toward a position of your choice where your skills, education and work experience would be relevant.  This resume may or may not be relevant to your mock business.  The goal here is to create a resume that will showcase your talents and be useful outside of this class. Writing a quality résumé and accompanying application letter is a process of self-reflection and self-promotion. You need to accurately represent yourself, celebrate your accomplishments, and demonstrate your abilities and experience, but you do not want to oversell yourself. This assignment has two parts: Part 1: Using either the Functional or Chronological Résumé format from our textbook, craft your résumé. Part 2: Then, write a letter of application using the format in our textbook. Once you have completed these documents, combine them into a single document with your letter first and your résumé second, and submit this single document to the week four drop box.
