Handy Wheels and the Patent Issues

Handy Wheels is a small wheelchair manufacturer who designs and manufactures custom manual wheelchairs for active people with disabilities. One of its new designs uses a suspension system to create a smoother ride over rough terrain. Another wheelchair organization creates a chair with a virtually identical suspension system though the chair itself is not identical.

Assume Handy Wheels owns the patent on the suspension and answer the following questions:

  • What course of action would it have against the competitor?
  • What remedies are available?
  • What defenses might the competitor assert?
  • What if Handy Wheels was in the process of applying for the patent but had not done it yet? Does that change the outcome?

Discuss your answer with appropriate reasoning.

Rosy’s Instructional Method

Rosy developed a particular kind of instructional method for exceptional kids, which she adapted from a variety of popular and well-known forms. She would like to patent her instructional form. Rosy wants to trademark her instructional method because she has noticed several teaching studios using variations of the wording she uses to describe her method though the class they are teaching is totally different.

On the basis of the above information, answer the following questions:

  • What advice can your firm give Rosy?
  • Can she trademark the method? Why or why not?
  • Can she do anything about the teaching studios that are using variations of her wording?

Provide a well-reasoned answer. Support you answer with relevant case law or statute

Propriety of Filing a Motion for Mistrial

Here, we are looking at motions for mistrial and then, specifically, whether this should be discussed in front of the jury. If you are interested in being a litigation paralegal, what are your expectations from this position?

Discuss the propriety of filing a motion for mistrial when the jury is present. Further, discuss the importance of having a litigation paralegal assist the trial attorney at trial. After covering the litigation process in detail, list and analyze the importance of an initial case investigation and case pleading in this process.

Justify your ideas and responses by using appropriate examples and references from Westlaw (including primary sources such as cases, statutes, rules, and regulations), government websites, and peer-reviewed legal periodicals (not lawyer blogs), which can be supplemented by law dictionaries or the textbook. This means you need to use more than just your textbook and legal dictionaries.

Merits of Bringing a Rule 56 Motion

Be careful with Rule 56. Might this still be a viable option if there are only a few questions of fact? Should a party be forced to litigate on things not in dispute?

A case appears to have questions of fact. Discuss the merits of bringing a Rule 56 motion in spite of the facts. Explain with suitable examples the importance of drafting comprehensive Findings of Fact and Conclusions of Law for a bench trial.

mortality

Robinson Jeffers’s “Where I?” and Tom Sleigh’s “The Very End” address the same theme: mortality. In both poems, the speaker reflects on another person’s—a woman’s—death. For this essay, you will choose ONE of these two poems (“Where I?” or “The Very End”) and make an argument about what exactly the speaker learns—about death or the woman—through his reflection on mortality and observation of the woman.

In your essay, you are required to quote specific words, phrases, and/or lines from the poem that are relevant to your argument. You must also close read the language in those quotations. Your analysis of those quotations must clearly support and connect to your overall argument.

“Where I?” and “The Very End” are sonnets, and, as we discussed in class, the sonnet is a specific poetic form; you may want to consider how the poem’s form relates to the speaker’s reflection on death. Additionally, use some of the following erms: metaphor, simile, alliteration, assonance, imagery, rhyme, personification, etc..

STRUCTURING ESSAY 1

Paragraph 1:

  • Your introductory paragraph must introduce the text and the key ideas of your paper. It must include the title and author of the text you are writing on. It must lead up to a clear thesis statement, which offers a specific argument about the text and not just a plot summary. It must also end with a strong transition to your next paragraph.

Paragraph 2, 3, etc. (body paragraphs—as many as needed)

  • Each body paragraph must begin with a clear topic sentence forecasting the content of the paragraph. Each paragraph must include textual evidence that supports your thesis and close reading of that textual evidence that also supports your thesis.

Conclusion

  • Your conclusion must link the various parts of your argument into one cohesive whole. Reassert and restate your argument in new words. Because essay 1 is so short, your conclusion may be 2-3 sentences at the end of your final body paragraph.

Strategic HRM Plan Benchmark Assessment

Details:
Write a high-level strategic human resource management plan (3-4 pages).
The purpose of this assignment is to simulate the thought process managers use to connect unit goals with organizational strategy. The students are not expected to produce a detailed strategic plan (which in actual organizations can exceed 100 pages). Rather, the expectation is that students demonstrate consideration of the multiple complexities involved in strategic planning.
The assignment is centered on the strengths, weaknesses, opportunities, and threats (SWOT) model of analysis, and the specific, measurable, achievable, relevant, and time-bound (SMART) model of goal setting.
Access the GCU Library, relevant course materials, Internet resources, and the HRM Webliography to research SWOT analysis, SMART goals, and models of strategic proposals.
Access your Scenario Generator Report, which includes a description of the organization, points to reflect on, a SWOT analysis, and directions for a SMART goals report. Use this information to write the Strategic HRM Proposal.
The Strategic HRM Proposal should be in the form of a professional report. There is no single, correct manner of presentation. Creative thinking is expected. The formatting is secondary to the content and application of knowledge. However, the proposal should be organized in a readily comprehensible manner that conveys a thorough understanding of course objectives. Graphics, bulleted lists, tables, and charts are acceptable. Include the following:

  • Introduction and conclusion that make relevant connections to course objectives.
  • Summary of the organizational description included in your Scenario Generator Report.
  • Reflection and application of each point included in your Scenario Generator Report (two to three fully developed sentences per item).

While APA format is not required for the body of this assignment, solid academic writing is expected, and in-text citations and references should be presented using APA documentation guidelines, which can be found in the APA Style Guide, located in the Student Success Center.

Instructors will be using a grading rubric to grade the assignments. It is recommended that learners review the rubric prior to beginning the assignment in order to become familiar with the assignment criteria and expectations for successful completion of the assignment.
